Basic terminology:

1. Introduction
Joy Suites Hospitality Private Limited (“Joy Suites Hospitality”) provides villas, bungalows, farmhouses, homestays, service apartments, and/or their individual rooms to guests, primarily for residential purposes, under the brand name “Joy Suites Hospitality.” The following Terms and Conditions apply to all guests or customers who make bookings for any of the Properties (defined below) or their individual rooms through our website, mobile application, third-party websites, third-party applications, travel agents, third parties, advertisements, referrals, etc. (collectively referred to as “Booking Channels”). All guests should read and understand all the Terms and Conditions stated on our website before using this website and making a booking through any of the Booking Channels. These Terms and Conditions apply to all bookings made through any Booking Channels. If you do not agree to any of these Terms and Conditions, please refrain from using this website/Booking Channels and from making a booking for any of the Properties.

  1. Terms and Conditions Updates These Terms and Conditions are subject to change, and Joy Suites Hospitality may, at any time and without prior notice, revise them or any other information contained in this website and/or any Booking Channel by updating these Terms and Conditions. The restated Terms and Conditions shall be effective immediately upon posting. Joy Suites Hospitality may also make improvements or changes to the services described on this website/Booking Channels at any time without notice. Therefore, you are advised to regularly check for any amendments or updates to these Terms and Conditions. Continued use of the website implies acceptance of the updated terms.
  2. Supremacy of Terms and Conditions Except where additional terms and conditions are provided, these Terms and Conditions supersede all previous representations, understandings, or agreements and shall prevail despite any variance with other terms of any order placed or service provided by Joy Suites Hospitality.
  3. Definitions For the purpose of online and offline bookings made through our platform, the terms used in these Terms and Conditions are defined as follows:
  • (a) “Property/Properties” shall refer to villas, bungalows, farmhouses, homestays, service apartments, and/or their individual rooms available for booking on any of the Booking Channels.
  • (b) “Guest/Guests” refers to any individuals, companies, or other entities interested in making a booking for any of the Properties through any Booking Channels. Guests may be referred to as “you” or “your” in the appropriate context.
  • (c) “Booking” means a reservation made by any Guest for any of the Properties for the purpose of stay.
  • (d) “Check-In” is the scheduled date and time by which Guests must complete all check-in formalities required by Joy Suites Hospitality. After completing these formalities, the Guest is entitled to begin using the booked Property.
  • (e) “Check-Out” is the scheduled date and time by which the Guest must vacate the Property after completing all check-out formalities required by Joy Suites Hospitality.
  • (f) “Booking Period” refers to the period from the start of the scheduled Check-In to the end of the scheduled Check-Out.
  • (g) “Booking Amount” is the total amount payable by the Guest to Joy Suites Hospitality to confirm the Booking through the registered mode of payment, as intimated by Joy Suites Hospitality to the Guest.
  • (h) “Booking Confirmation” is the email or communication sent by Joy Suites Hospitality to the Guest upon receipt of the Advance (defined below). It contains all the details of the Booking, including the Terms and Conditions governing the Booking, the names and total number of Guests, Check-In and Check-Out details, name of the Property, number of rooms at the Property, the Booking Amount payable, the Security Deposit amount payable, and the specified due dates for payment. Joy Suites Hospitality is not obligated to honor a Booking unless the entire Booking Amount is paid by the Guest to Joy Suites Hospitality through the registered mode of payment, even if a Booking Confirmation has been sent. The Booking Confirmation and proof of payment of the entire Booking Amount must be presented by Guests at the Property during Check-In.
  • (i) “Advance” is the non-refundable amount required to be deposited by Guests with Joy Suites Hospitality to secure a Booking Hold (as described below) for a Property.
  • (j) “Security Deposit” is the amount required to be deposited by Guests on a case-by-case basis with Joy Suites Hospitality. The Security Deposit may be used by Joy Suites Hospitality to cover any damages caused by the Guests or their pets to the Property and/or its furnishings, or to recover any other charges levied by Joy Suites Hospitality on Guests.
  • (k) “Peak Days” includes long weekends, festive dates such as Diwali, New Year’s, Christmas, etc.

 Acknowledgement and express content:

our use of this website is subject to the Terms and Conditions of Use mentioned here, along with the Privacy Policy and all other policies listed on Joy Suites Hospitality’ website. The terms and conditions outlined on Joy Suites Hospitality’ website form a binding agreement between you and Joy Suites Hospitality regarding your use of this website and the services provided. By accessing, viewing, browsing, caching, storing, or otherwise using our website or any of our services, applications, contents, or functions through any platform, and/or by completing a Booking, you acknowledge and agree that you have read, understood, and accepted all the terms and conditions set out on the website (including the Privacy Policy) and agree to be bound by them.

These pages, the content, the infrastructure of these pages, and the online accommodation reservation service provided on these pages and through the website (referred to as “the Service/s”) are owned, operated, and provided by www.joystays.in and are offered for your personal, non-commercial use only, subject to the terms and conditions outlined below.


Eligibility to Use Booking Channels:

The use of our Booking Channels for making a reservation in respect of a property is available only to individuals who can legally enter into binding contracts under the Indian Contract Act, 1872. Persons deemed ‘incompetent to contract’ as defined under the Indian Contract Act, 1872 are not eligible to use our Booking Channels to make a reservation in respect of a property.

Limited License and Restrictions:

Joy Suites Hospitality.in grants you a non-exclusive, non-transferable, and limited permission to access and display the web pages within this website on your personal computer or other platform. Any failure to comply with the terms, conditions, and notices on this website will result in the automatic termination of any rights granted to you, without prior notice. Except for the limited permission provided above, Joy Suites Hospitality.in does not grant you any express or implied rights or licenses under any patents, trademarks, copyrights, or other proprietary or intellectual property rights. You may not copy any of the content from this website onto another website or any other media without prior written consent from Joy Suites Hospitality.in.

You agree not to use any device, software, or routine to interfere or attempt to interfere with the proper working of this website or any transaction being conducted via this website. You also confirm that no copying, reproduction, alteration, modification, creation of derivative works, or public display of any content will be done by you except with prior written consent from Joy Suites Hospitality.in.

Furthermore, the information you provide to us shall not contain any viruses, including but not limited to Trojan horses, worms, time bombs, cancel bots, or other computer programming routines intended to damage, detrimentally interfere with, surreptitiously intercept, or expropriate any system, data, or information.

Services

Joy Suites Hospitality.in serves as both an online and offline platform for booking accommodations at affordable prices. In addition to booking services, Joy Suites Hospitality.in hosts content about various properties. Please note that the inclusion of any amenities or services at the properties does not imply or guarantee their availability at all times. Joy Suites Hospitality.in reserves the right to discontinue or modify the availability of these amenities or services at any time without prior notice.

Content Accuracy and Liability

Joy Suites Hospitality.in has taken every precaution in preparing the content of its booking channels, website, and mobile application to ensure that the rates quoted are correct at the time of publication and that all details are accurately displayed. However, you understand and agree that Joy Suites Hospitality.in shall not be liable for any typographical, technical, or other errors that may occur on the booking channels.

Additional Guest Services

To provide complete comfort to our guests, Joy Suites Hospitality.in may, at its sole discretion and subject to availability, arrange additional services such as chefs, cleaners, vehicle hire, and more by outsourcing these services from third-party vendors upon prior request.

Guests should understand and agree that these services may not be included in the Booking Amount, Advance, or Security Deposit paid. These additional services may incur extra charges. Joy Suites Hospitality.in offers these services solely for the convenience of guests without any commitment or obligation of any kind on the part of Joy Suites Hospitality.in.

Tariff and Pricing Policy:

The tariffs mentioned on Joy Suites Hospitality.in’s Booking Channels are non-negotiable and are subject to change without prior notice. All rates provided are based on room or multiple-room occupancy. Depending on the type of property, the tariffs may or may not include applicable taxes.

In the event of any technical glitch that leads to inaccurate tariff display on our booking channels, Joy Suites Hospitality.in reserves the right to correct such errors. Any incorrect or erroneous tariff displayed due to such technical issues will not be enforceable against Joy Suites Hospitality.in.

Guest Access and Check-In Policy:

When making a booking through Joy Suites Hospitality.in, it is understood and accepted by all Guests that they shall not at any time have possession, charge, or any claim of possession over any property booked through Joy Suites Hospitality.in.

Check-In Requirements:

  1. Booking Confirmation: Guests must present the Booking Confirmation issued by Joy Suites Hospitality.in along with proof of payment for the entire booking amount.
  2. Government ID Verification: As per government regulations, all guests must provide original government-issued photo IDs for verification and submit copies upon or before check-in.
  3. Guest Register: Guests are required to enter their names, addresses, and other relevant details, including those of accompanying children, in the Guest Register at the property, which may be maintained physically or digitally.
  4. Minor Guests: Guests under the age of 18 must be accompanied by at least one adult.

Failure to comply with the above requirements will result in denial of entry to the property. In such cases, no refund or compensation will be provided.

If any false or incorrect information is provided during the booking process, Joy Suites Hospitality.in reserves the right to cancel the booking and deny access to the property. If the guests have already checked in, they may be evicted without any refund or compensation.

Guest Capacity:

The number of guests, including visitors, must not exceed the number specified at the time of booking. Joy Suites Hospitality.in may allow additional guests at its sole discretion and at an additional cost. Any such arrangements must be confirmed in writing by Joy Suites Hospitality.in.

Additional Fees

Joy Suites Hospitality.in reserves the right to charge and apply additional fees, including reservation or facilitation fees, at any time without prior notice to guests.



Assumption of Risk:

By using this website, you acknowledge and agree that you fully assume the risks associated with any transactions conducted through this platform. This includes assuming all liability or potential harm related to any subsequent activities or issues concerning the accommodation subject to these transactions.

Third-Party Links:

The website may include links to third-party websites and web pages. Joy Suites Hospitality does not represent, endorse, or take responsibility for the content or practices of these third-party sites. We have no control over and are not liable for any claims or issues that may arise from your use of these external websites.

Promotional Content:

By sharing your contact details on our website, you agree to receive promotional content from Joy Suites Hospitality via WhatsApp, email, push notifications, and SMS. Joy Suites Hospitality may provide you with various discounts, offers, and promotional schemes. These promotions are subject to specific terms and conditions listed on our website, which may change periodically. Joy Suites Hospitality reserves the right to modify or withdraw any promotional scheme at any time without prior notice.

Payment and Booking Confirmation:

Guests acknowledge and agree that by paying the Advance and/or Security Deposit (as applicable) or receiving a Booking Confirmation, they have read, understood, and unconditionally accepted all terms and conditions associated with the Booking.

Please note that the issuance of a Booking Confirmation does not guarantee that the Booking is confirmed. Joy Suites Hospitality will not consider a Booking confirmed until the entire Booking Amount has been received through the registered payment method specified by Joy Suites Hospitality. If the full Booking Amount is not paid by the due date, the Booking Confirmation will be canceled, withdrawn, and deemed null and void.

For Bookings made through third-party websites, applications, travel agents, advertisements, or referrals, Guests must confirm their Booking directly with Joy Suites Hospitality. Joy Suites Hospitality will not be liable to honor a Booking unless the full Booking Amount is received through the specified payment method, regardless of any Booking Confirmation sent by third parties. Additionally, any terms and conditions of the third-party source will also apply to the Booking, alongside Joy Suites Hospitality’ terms. In cases where third-party terms conflict with Joy Suites Hospitality’ Terms and Conditions, the terms set by Joy Suites Hospitality will prevail.


Booking Hold and Payment Terms:

Upon receipt of the Advance and Security Deposit, Joy Suites Hospitality will place the Booking in “Booking on Hold” status. The Booking will be confirmed and served by Joy Suites Hospitality only upon receipt of the full Booking Amount through the specified payment method.

If the entire Booking Amount is not received by Joy Suites Hospitality by the specified due date and through the registered payment method, Joy Suites Hospitality will not be liable to honor the Booking.

Check-In and Check-Out Times:

Check-In and Check-Out times will be specified in the relevant Booking Confirmation. Joy Suites Hospitality recommends that Guests adhere to the specified Check-In time. Early arrival may not be accommodated, and if Guests arrive before the Check-In time, they may be subject to an additional charge at Joy Suites Hospitality’ discretion.

If an alternative Check-Out time is approved by Joy Suites Hospitality, it will be communicated in writing. Guests are required to vacate the Property by the Check-Out time stated in the Booking Confirmation. Occupying the Property beyond this time may incur an additional charge, as determined by Joy Suites Hospitality.

Advance Payment / Security Deposit by guest and Damaged of the property:

To secure a Booking, Guests must pay an Advance prior to receiving the Booking Confirmation. This Advance acts as security to protect Joy Suites Hospitality against potential revenue loss due to cancellations or non-payment of the remaining balance.

If the Advance is not received, the Booking Confirmation will not be issued.

Guests are responsible for inspecting the Property and reporting any damage to the equipment, appliances, cutlery, crockery, utensils, furniture, fittings, furnishings, or structure within 90 minutes of Check-In. Failure to report damages within this period will result in the damage being deemed as occurring during the Guest’s stay. Guests will be liable for reimbursement to Joy Suites Hospitality for any such damages without delay.

Guests must use the Property and its items with utmost care. At Check-Out, the Property should be left in good order and reasonably clean, except for normal usage wear.

In cases where a single item from a set is damaged and an identical replacement is not available, Guests will be liable for the replacement cost of the entire set. For example, if a glass from a set of six is broken, the Guest will need to pay for all six glasses.

Guests must not move or relocate any equipment, appliances, furniture, fittings, furnishings, or artifacts from their original locations without prior consent from Joy Suites Hospitality, except for movable items like chairs or plastic furniture.

Joy Suites Hospitality may not be able to inspect the Property for damages immediately at Check-Out due to the need to inspect multiple rooms and facilities. The inspection will occur between Check-Out and the next Check-In. Refunds of the Security Deposit, after deducting any charges for damages, will be processed within 30 days of Check-Out. The assessed cost of repairs or replacements will be communicated to Guests, and this assessment will be final and binding.

If the cost of repairs or replacements exceeds the Security Deposit, Guests will be notified in writing and will be required to pay the excess amount within 7 days of notification. Refunds of the Security Deposit will be made via cheque or bank transfer to the account details provided by the Guests, or through the original payment method used.

Modes of Payment:

Joy Suites Hospitality accepts payments through the following registered modes:

  1. Credit Card/Debit Card

Payments can be made using credit cards, debit cards, or any other card including, but not limited to, Visa, MasterCard, RuPay, and American Express. The availability of card types may be listed on the Booking Channels from time to time.

  1. Net Banking

Payments can also be made using your bank’s internet banking services. Any charges levied by banks or payment gateways are independent of Joy Suites Hospitality and Joy Suites Hospitality holds no liability for such charges.

Payment Non-Compliance

If any amount due from the Guest/Guests to Joy Suites Hospitality is not paid, Joy Suites Hospitality will not be obligated to process or serve the Booking.

Card Details and Liability

You agree and confirm that the credit/debit card details or other financial information provided by you will be accurate and correct. You shall only use credit/debit cards or financial facilities that are lawfully owned or obtained by you. Joy Suites Hospitality will not be liable for any credit/debit card fraud. The responsibility for any fraudulent use of a card lies with you, and the burden of proof otherwise will be solely on you.

Pet Policy:

Pets may or may not be allowed on the Properties at the discretion of Joy Suites Hospitality. Any such allowance will be detailed in the Booking Confirmation issued to Guests. Joy Suites Hospitality may, at its discretion, charge a non-refundable Pet Fee.

If Guests or their visitors bring pets to the Property without prior written approval from Joy Suites Hospitality, or if the pets are not those specifically approved, such pets will not be allowed entry to the Property. If Guests have already Checked-In, they may be evicted from the Property.

When pets are allowed, they must be kept on the Property and under the control of the Guests at all times. Guests are solely responsible for ensuring that their pets do not soil, spoil, or damage the Property or its items/furniture. Additionally, Guests must ensure that their pets do not create any nuisance to neighbours or other individuals around the Property.

Breach of Terms:

Any breach of the terms and conditions stated herein will result in the automatic and immediate termination of the Booking. This will also lead to the immediate eviction or removal of Guests from the Property and the forfeiture of the entire Booking Amount or any other amounts paid by the Guests. No refunds will be provided for amounts paid or deposited by the Guests.

 

Booking Cancellation by Joy Stay:

Joy Suites Hospitality reserves the right to cancel a Booking at any time without prior notice to the Guest(s). For details on our Cancellation Policy, please visit our Cancellation Policy.

Guest Conduct and Use of Property:

  1. Guests agree that the Property is a residential space with neighboring residents. It is crucial that the conduct of the Guests does not disturb the tranquility, peace, or modesty of the neighbors.
  2. The Property is intended solely for accommodation purposes and must not be used for any other activities.
  3. Guests must avoid causing any nuisance to neighboring properties.
  4. To prevent disturbance to neighbors, Guests should ensure that no loud music is played in outdoor areas such as the poolside, garden, balconies, or terraces.
  5. The Property must not be used for any unlawful or immoral activities. StayVista and its representatives, employees, and agents are not responsible for any such actions by Guests.
  6. Possession or consumption of prohibited drugs and organizing rave parties are strictly prohibited. Violations will result in immediate police involvement and potential eviction from the Property.

    Confidentiality and Applicable Laws

Any information collected by us will be kept confidential according to our Privacy Policy. Additionally, the following laws, rules, guidelines, and regulations govern the use of our Online Booking Channels:

  1. Information Technology Act, 2000: Relating to the processing of personal data, as amended from time to time.
  2. Information Technology (Intermediary Guidelines) Rules, 2011: As amended from time to time.

iii. Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011: As amended from time to time.

Information provided for any Booking made through our Offline Booking Channels will also be kept confidential in accordance with these Terms and Conditions.

Intellectual Property Rights:

Unless stated otherwise, all software required for our services or available on or used by our Online Booking Channels, as well as all intellectual property of the contents, information, and material on our Booking Channels, are wholly and exclusively owned by Joy Suites Hospitality. This intellectual property includes, but is not limited to, all developments, proprietary information, trademarks, trade names, logos, artwork, slogans, service marks, domain names, brand names, know-how, processes, methods, trade secrets, designs, and any other work in which copyright may subsist.

You are not entitled to copy, scrape, (hyper-/deep) link to, publish, promote, market, integrate, utilize, combine, or otherwise use the content or brand of Joy Suites Hospitality. To the extent that you would (wholly or partly) use or combine our content or otherwise claim any Intellectual Property Rights in the Online Booking Channels, you hereby irrevocably and unequivocally assign, transfer, and set over all such Intellectual Property Rights to Joy Suites Hospitality.in.

Any unlawful use or any of the aforementioned actions or behaviours will constitute a material infringement of our Intellectual Property Rights.

Limitation of Liability:

The Guests understand and agree that Joy Suites Hospitality.in operates solely as an online and offline booking platform, and Joy Suites Hospitality.in shall have no liability in the following situations and/or any similar situations:

  1. a) In the event of any accidents, fire, hazards, injuries, or death(s) resulting from any reason, including but not limited to conflicts or quarrels between Guests, or between Guests and the caretaker of the Property, or any other emergency situations at the Property involving Guests, caretakers, or third parties.
  2. b) If any illegal or hazardous activities are conducted by the Guests or any other individuals accompanying the Guests at the Property, Joy Suites Hospitality.in shall not be liable for any consequences arising from such activities.
  3. c) In the case of any criminal acts, including but not limited to discrimination, harassment based on race, national origin, religion, gender, gender identity, physical or mental disability, medical condition, marital status, age, sexual orientation, theft, murder, kidnapping, criminal negligence, use of narcotics, prostitution, rave parties, or any obscene acts committed by or to the Guests, their companions, caretakers, or any third parties.

 

Property Description and Guest Responsibility:

Joy Suites Hospitality.in strives to provide accurate and realistic pictures of the Properties. However, if the description or depiction of the Property is materially inaccurate regarding its size or other features, Joy Suites Hospitality.in shall not be held responsible or liable.

During the Booking, if amenities such as decks, pools, hot tubs, bathrooms (toilet/shower/bathtub), kitchen appliances (sink/stove/refrigerator or major appliances), or electrical, heating, or air conditioning systems are missing or not functioning as depicted in the pictures on our Booking Channels, or if you are dissatisfied with cleanliness (including bedding, towels, etc.), or if you encounter issues related to insects, unpleasant odors, or deficiencies in services and amenities (such as electricity, gas, water, swimming pool, Wi-Fi, medical box, or electronic appliances), you must notify Joy Suites Hospitality.in in writing or via telephone or WhatsApp within 12 hours of Check-In. Please provide evidence, including photographs if possible. Joy Suites Hospitality.in will make reasonable efforts to address these issues but will not be liable if they are not resolved in a timely manner. Joy Suites Hospitality.in will not be obligated to offer a refund or compensation if the issues are not resolved. The decision of Joy Suites Hospitality.in in such matters will be final.

You agree and understand that any issues must not have been caused directly or indirectly by your actions, omissions, or negligence.

If the Property is occupied by other visitors at your Check-In time, Joy Suites Hospitality.in will make reasonable efforts to find and book you another Property comparable to your original Booking in terms of size, rooms, features, and quality.

Limitation of Liability:

You understand and agree that Joy Suites Hospitality.in will not be liable for any loss or damage incurred during the Booking and/or related to the use of this website or the making of any reservations if such loss or damage arises out of a Force Majeure Event.

Force Majeure Event refers to any act, event, or accident beyond the control of Joy Suites Hospitality.in, including but not limited to:

  • Strikes, lock-outs, or other industrial disputes (whether involving Joy Suites Hospitality.in’s workforce or any other party)
  • Failure of a utility service or transport network
  • Acts of God, such as natural disasters (e.g., earthquake, flood, storm)
  • War, riot, civil commotion, or malicious damage
  • Compliance with any law, governmental order, rule, or regulation
  • Accident, breakdown of plant or machinery, or fire
  • Epidemics or pandemics

Joy Suites Hospitality.in will not be responsible for any loss or damage resulting from such events.

Termination of Use:

You understand and agree that Joy Suites Hospitality.in reserves the right to terminate your registration and/or your right to use this website for any reason, including but not limited to any act or omission that contravenes the Privacy Policy or these Terms and Conditions of Use.

Joy Suites Hospitality.in may affect such termination without prior notice. You acknowledge and agree that Joy Suites Hospitality.in may delete or deactivate your account immediately upon detecting any reason for termination, including but not limited to a breach of the Privacy Policy or these Terms and Conditions of Use.

Dispute Resolution:

Any disputes, claims, or differences arising in relation to the Booking or any matters related to the Booking shall be referred to arbitration. The arbitration shall be conducted by a sole arbitrator, whose decision shall be final and binding. The sole arbitrator shall be mutually appointed by the parties involved.

The arbitration shall be held in Mumbai and governed by the provisions of the Indian Arbitration and Conciliation Act, 1996, as amended from time to time. The proceedings shall be conducted in English.

Subject to the arbitration provisions, the competent courts in Mumbai shall have jurisdiction over any matters arising from or related to the Booking.

Assignment:

Any Bookings made by the Guests are not assignable.

Notices and Communications:

Any notices or communications from Joy Suites Hospitality.in to the Guests shall be provided in writing and may be sent by (i) email to the address provided by the Guest, or (ii) by posting on the Site or through the Application. For notices sent via email, the date of receipt shall be deemed to be the date on which the email is transmitted.

Indemnification:

By making a Booking, you affirm that the Booking is for private, residential, and personal use only, and not for commercial purposes or any other use. You expressly indemnify Joy Suites Hospitality.in and agree to hold Joy Suites Hospitality.in harmless from any loss or damage arising from any breach of this assurance, including but not limited to, loss of profits, indirect loss, consequential loss, loss of income, damage to property, and loss of reputation.

Guests agree to indemnify, defend, and hold harmless Joy Suites Hospitality.in, its affiliates, contractors, employees, officers, directors, and agents, from and against any claims, losses, damages, liabilities, costs, and expenses, including legal fees, arising from or related to the use or misuse of the services or Booking Channels, any violation of the Terms and Conditions, or any breach of the representations, warranties, and covenants made herein.

Feedback:

Joy Suites Hospitality.in encourages you to provide feedback, comments, and suggestions for improving the Site, Application, and Services (“Feedback”). You can submit your Feedback by emailing us at joysuiteshospitality@gmail.com

Waiver of Rights:

The failure of Joy Suites Hospitality.in to exercise or enforce any right or provision of these Terms and Conditions will not constitute a waiver of such right or provision.

Grievance Handling:

Joy Suites Hospitality.in strives to deliver the highest quality of services. If you have any grievances regarding any aspect or feature of the website, please contact us at joysuiteshospitality@gmail.comWe will address all grievances as promptly as possible.
